The European Court of Human Rights has ruled repeatedly that excessive delays in legal proceedings and the lack of an effective remedy for such delays violate Articles 6 and 13 of the European Convention on Human Rights.

The Czechoslovak Socialist Republic nationalized family's fruit manufacture "Vitamina" after 1949. In 2012 the family's successor bought the orchardry "Vitamina" in a public auction organized by the Regional Court in Prague.
The District Court for Prague 5 invalidated the auction in 2014, but the Regional Court in Prague never returned the 4 mio CZK paid for orchardry "Vitamina", which resulted in a claim against the Czech state filed with the District Court for Prague 2.
An incompetent judge of the Regional Court in Prague ordered the auction office to proceed with the auction despite being aware of the missing consent for the auction agreement, which lead to the auction's invalidity and state's liability.
When courts issue rulings that disregard the law, it undermines confidence in the justice system and democratic institutions, leading to scepticism and more.
Unlawful decissions can create legal precedents that distort future interpretations of the law, affecting not just one case, but many others that will inadvertently follow.
Individuals lose the ability predict outcomes and protect their rights when rulings are arbitrary (careless or cabinet), breaching the principle of certainty and access to justice.
